[WSBARP] Ot-Contract dispute ?

List mates:

 

Our firm represents a client (seller) who sold a horse via a properly
executed contract (between buyer and seller) about 6 months ago. Contract
was properly signed and executed however no attorney fee clause if suit
was to be filed. The contract contained no warranties to return the horse
if problems arose.

 

The horse was sold for about $10,000.00. The buyer prior to purchase paid
a well-known veterinary facility to inspect, conduct a review of the
horse, including neurological and physical exams. The horse went through
with flying colors, no deficiencies. Then the buyer conducted a second
review by riding the horse at professional facility prior to purchase.

 

About a week ago client receives a demand from buyers attorney for
settlement of the defective horse (6 months post purchase). Buyer is
claiming that the horse has a neurological disorder now and that a new vet
is claiming the first vet should have caught this. 

 

Buyers attorney is demanding a settlement to be paid to their client.
Buyers attorney is claiming that this is a “mutual mistake under law.” And
cited some case law.

 

Any defense to this? Thoughts? Case law?
