Without a POA, her husband would have surrogate authority.  She isn’t

Why doesn’t she just terminate the AIF?  I mean if she’s not going to name
a new one and remove him as AIF, what’s the point of having one?

Hi, all,

 

My client asked if she can exclude her husband from acting as her
attorney-in-fact for health care without naming someone else as AIF.  I
don’t know of any authority for this, but I wonder if anyone has run into
this situation and has a solution.

 

R.C.W. 11.94.100(2) provides that a principal can specify in a power of
attorney that certain persons shall not be entitled to file a petition
under R.C.W. 11.94.090 to interfere with the agent’s administration under
the provisions of the power of attorney.
