adjoining parcels. I was surprised to see my clients persist in that lengthy and pricey process to lender approval without a total re-finance<o:p></o:p></span></p>

<p class="MsoNormal"><span style="font-size:11.0pt">In the “testamentary division” context, 30+ years ago an elderly and terminally-ill client of mine was approached by three individual investor/partners who combined to make him an unusual proposal: He had
been unable to sell a 20-acre parcel that (if I recall correctly) either already had been or was about-to-be downzoned zoned to 5-acre minimum lots sizes if short-platted. They offered to purchase the property for a handsome up-front down payment on closing,
with him carrying back a note and deed of trust with $1K per month note payments at 5% interest if he agreed to maintain in effect a will with testamentary division of the 20-acres naming them (along with at least 7 other parties related to buyers) as individual
testamentary beneficiaries. They provided legal descriptions for the separate testamentary gifts. My estate planning client bought into the idea, having been unable to find a buyer for his parcel of land, and needing the payments. I thought the idea was
totally cockamamy and received assurance they were assuming all risks! <o:p></o:p></span></p>

of the three parcels; Parch 2 gets 35% of mortgage obligation; and Parcel 3 gets 25% of mortgage obligation. <o:p></o:p></span></p>

ramifications where they could lose their very nice "covid" interest rate? (I have requested a copy of the mortgage document itself). <o:p></o:p></span></p>
