My case is very contested. I represent the surviving wife, who was appointed PR over the community property. We actually did all of the required probate things. The PR, appointed in the husband’s Will, was an adopted child who did not want to follow the Will or any of the procedures, and refuses to deed over property given to the Wife. This all started in 2022; the court ordered mediation twice, but the PR refused to agree on a mediator. I tried to remove him, but that was when the court ordered the second mediation. This case was ready to close in 2022. In looking at the Statute, of course, the PR is to propose the final report. He won’t. He wants the wife to give him the real estate she is to get. He’s already gotten everything else. I am ready to file the final report, but my client is not the PR.
