exist; there is no real justification for not obtaining through simple legal process from the STATE COURT that is holding it; it is NOT YET PROBATED in another state court (and thus cannot be exemplified, certified, or anything else’ified).<o:p></o:p></span></p>
<p class="MsoNormal"><span style="font-size:11.0pt;font-family:"Calibri",sans-serif"><o:p> </o:p></span></p>
<p class="MsoNormal"><span style="font-size:11.0pt;font-family:"Calibri",sans-serif">In Alaska – as with whatever state our friend Laura is engaging with – it truly is the ONE AND ONLY ORIGINAL that is “on file” with the local state court. It is not lost, it
is not probated, etc.<o:p></o:p></span></p>
<p class="MsoNormal"><span style="font-size:11.0pt;font-family:"Calibri",sans-serif"><o:p> </o:p></span></p>
<p class="MsoNormal"><span style="font-size:11.0pt;font-family:"Calibri",sans-serif">So I would want to caution that to my legal analysis, it is proper to perhaps file with a “photocopy” of the “presumed original on file with the District Court for the State
of [Alaska]” but which ONLY ANOTHER STATE COURT CLERK’S OFFICE can obtain by contacting and cooperating with that other court.<o:p></o:p></span></p>
<p class="MsoNormal"><span style="font-size:11.0pt;font-family:"Calibri",sans-serif"><o:p> </o:p></span></p>
<p class="MsoNormal"><span style="font-size:11.0pt;font-family:"Calibri",sans-serif">It’s a very odd situation. I had no idea such things existed until this Alaska situation played out. But, as I say, once the local clerk “here” understood, they were in touch
with the Alaska clerk the same day, and the <u>original</u> and <u>unprobated</u> will was in our local court’s hands by their own direct court-to-court process.<o:p></o:p></span></p>

court. <o:p></o:p></span></p>
<p class="MsoNormal" style="margin-bottom:8.0pt;line-height:105%"><span style="font-size:11.0pt;line-height:105%">When the testator passes away, the court in question will only:<o:p></o:p></span></p>
<p class="MsoNormal" style="margin-bottom:8.0pt;line-height:105%"><span style="font-size:11.0pt;line-height:105%">1) Provide certified or exemplified copies; <o:p></o:p></span></p>
<p class="MsoNormal" style="margin-bottom:8.0pt;line-height:105%"><span style="font-size:11.0pt;line-height:105%">2) File the will in THAT COURT to open probate; and/or <o:p></o:p></span></p>
<p class="MsoNormal" style="margin-bottom:8.0pt;line-height:105%"><span style="font-size:11.0pt;line-height:105%">3) Send the original will directly to the court of another state upon a request directly from another court.<o:p></o:p></span></p>
<p class="MsoNormal" style="margin-bottom:8.0pt;line-height:105%"><span style="font-size:11.0pt;line-height:105%">Apparently, #3 is typically done by email from the clerk of the court, but I’m flummoxed as to how I would get the Clerk of a Washington court
to email the other state clerk. <o:p></o:p></span></p>
<p class="MsoNormal" style="margin-bottom:8.0pt;line-height:105%"><span style="font-size:11.0pt;line-height:105%">Here in Washington, I am aware of procedures for probating an exemplified copy
<u>when probate is open in another state</u>. I am aware of procedures for probating a copy of a
<u>lost or destroyed will</u>. Neither of these appear to be a fit. <o:p></o:p></span></p>
