<p class="MsoNormal">In cases like this, I have the clients receive local advice from counsel in the country where they reside. Depending on advice of counsel in the foreign jurisdiction, they may need additional US-based planning. If they end up needing
US-based documents like wills or trusts, I look at where they are registered to vote, where they stay if they regularly visit, where they file taxes for US-based income, where they have a driver license, what addresses they use when a financial institution
requires them to have a US address, etc. If everything is pointing to one state, it probably makes sense to have their wills covering US assets comply with that state’s law. It is also important to remind the client to obtain tax advice from an accountant
in their country to ensure they have an understanding of how any money flowing into that country from the US via their estate will be treated.<o:p></o:p></p>
