One was disclaimed, for tax reasons, and the other is going to a special needs trust. The local department people don’t like the fact the disclaimer trust was not set up until after death and the Will, providing for the disclaimer and trust, did not specifically name the trust. Although the other Will specifically calls for the creation of the special needs trust for a specific child, the name in the Will does not match the child’s current name.
