I have a more specific question I am trying to ferret out too—does the “discovery rule” do anything to toll the creditor’s claim time limits (this is NOT a wrongful death claim)? The would-be plaintiff had actual notice that the decedent passed away, and has participated in the proceedings from the very beginning. They weren’t given an actual creditor’s claim notice, though, because the PR had no way of knowing about the decedent’s alleged actions that give rise to the potential claim. The plaintiff may assert that they only “discovered” the claim after the 4 month period elapsed.
