We have a case pending in Thurston county and the issue is language “ to children share and share alike” mean the testator required survivorship of the children to inherit and what is application of anti-lapse statute. I also could find no Washington cases
on point other that the crt saying time and time again must apply the statute unless survivorship is required by language of the will.</p>

I did some brief research on “share and share alike” recently. I found some authority indicating that it means equal shares to surviving members of the class/group. In my case the issue was whether the “share and share alike” language prevented application
of the anti-lapse statute. The parties in my case signed a TEDRA agreement confirming application of the anti-lapse statute, so we did not need to research further. I don’t believe we found any Washington authority.</p>
