<p>While tenancy in common interests in real property would not be
able to be liquidated within 20 days, is Estate Recovery recording
liens (while medicaid recipient is alive) or collecting liens
claims against tenancy in common interests in non-residential real
property after the medicaid recient dies?</p>
<p>It looks to me as if such interests fall within the definition of
estate (under ). WAC 182-527-2730 Definitions. . . . "Estate"
means all property and any other assets that pass upon the
client's death under the client's will or by intestate succession
. . . . "<br>

<p>However, WAC 182-527-2746 "Estate recovery<span style="box-sizing: border-box;">—</span>Asset-related
limitations) specifies they may file a lien against Joint tenancy
assets, but not tenancy in common interests.</p>
<p>Maybe they don't because they don't have a right to sale under
the partition statute (7.52.010 Persons entitled to bring action.)
and since it looks like they won't even get notice of sale unless
a party brings them in as defendants (RCW 7.52.150 Lien creditors
to be brought in.)? <br>
