is solvent, and the will nominates this child, who would be the person entitled to letters in the absence of a will. . .

If all true, I would handle this as an intestate estate, BUT I would attach the purported will to the petition indicating why you are not trying to get it admitted to probate, but so as to be forthright and transparent with the Court.<o:p></o:p></span></p>
