Regarding an infidelity clause, a Ca. case held infidelity clauses that provide for payment of damages unenforceable and in violation of public policy underlying their no-fault divorce laws. <a href="https://law.justia.com/cases/california/court-of-appeal/4th/97/470.html" target="_blank">Diosdada v. Diosdada (2002)</a>.
