title company is whether it considers an affidavit in support of
the community property agreement is even necessary. The company
may request the surviving spouse sign its own form, that it may or
may not record with the auditor. The company may simply wish to
see a copy of the death certificate of the spouse that died in
2017, and it may or may not require that the death certificate be
recorded. The objective is simply to satisfy the title insurance
company; no statute requires recording such an affidavit or the
death certificate.<br>

My practice since 1978 has been to tell clients signing CPAs to
record it either upon signing or at the first death, then when the
surviving spouse seeks to sell the home to check with a title
company as to what it needs to see to be comfortable insuring
title to the buyer. Sometimes the passage of years following the
first death is sufficient to make a title company comfortable that
the surviving spouse may convey title.<br>

member or PR of the now-deceased spouse’s estate can sign
the (apparently never filed) affidavit in support of CP
agreement. This is the affidavit that should be recorded
later, separately from the CP agreement, after Spouse 1 dies
and Spouse 2 has survived and needs to vest title in Spouse
2 alone.

recorded by the <u>auditor</u> after submission of a REETA
(citing the relevant exemption), death certificate and $10
check to the
<u>treasurer</u>. (In my world, the REETA is not recorded.
From this listserv it seems some counties record it all.
