<p class="MsoNormal"><span style="font-size:12.0pt">I accepted one of their calls today on a probate where they have filed a claim. They wanted to know when we could pay it and I said if the wanted to be paid in full, we would be waiting until the claim period
was over so that we would be sure to have sufficient funds, but if they wanted to make a deal, we would consider paying early. They came back with a 10% reduction. Good for the client.<o:p></o:p></span></p>
<p class="MsoNormal"><span style="font-size:12.0pt"><o:p> </o:p></span></p>
<p class="MsoNormal"><span style="font-size:12.0pt">Another time, I happened to pick up their call. They told me their client did not intend to file a claim, but could we pay anyway, I told them that was unlikely, but I would present their request to the client.
Also good for the client. <o:p></o:p></span></p>
<p class="MsoNormal"><span style="font-size:12.0pt"><o:p> </o:p></span></p>
<p class="MsoNormal"><span style="font-size:12.0pt">If you call back be sure you are prepared to give them names, dates of birth, date of death and social security number for the decedent, they often won’t talk to you at all without that information.<o:p></o:p></span></p>
<p class="MsoNormal"><span style="font-size:12.0pt"><o:p> </o:p></span></p>
<p class="MsoNormal"><span style="font-size:12.0pt">Bottom line is I ignore their calls frequently, because they do call frequently, but sometimes taking the call works out well for the client or provides new information.<o:p></o:p></span></p>

<p class="MsoNormal"><span style="font-size:12.0pt">Because they are calling you know about them. If you know about them you should send them notice to creditors.<o:p></o:p></span></p>

decent people to deal with. They don’t want to leave a message because of strict federal laws about debt collection practices and disclosing confidential information. Call them back and get connected with them. It will cause fewer problems in the long run.<o:p></o:p></span></p>

<p class="MsoNormal">I would say that the calls from a collection agency giving the name of a decedent do make them a reasonably ascertainable creditor. I would mail them a notice to creditors, but no more. I would not get on the phone with them, or call them
back. No hand holding. Just mail them a notice and see if they file and serve a valid and timely claim. <o:p></o:p></p>
