<p class="MsoNormal">I recently bought a sealed document in a divorce with a decedent. In my case, I represented the ex-wife of the decedent, so I was able to file my Notice of Appearance for the ex-wife in the divorce (can’t remember the last time I appeared
in a Type 3 case before this…), went to the 6<sup>th</sup> floor, and patiently waited while they dug up the microfilm and sold me a copy of the Sealed Property Settlement Agreement. Note that any time you want to buy a sealed pleading, you have to appear
at the Clerk’s office in person for them to verify your driver’s license and Notice of Appearance in the case.<o:p></o:p></p>
<p class="MsoNormal">In your case, I think you can appear for the PR on behalf of the deceased party. I would expect the Clerk’s Office to treat you as counsel for a party, and sell you the Sealed pleading you want, except if it is one of the protected sealed
documents.<o:p></o:p></p>
<p class="MsoNormal">To Mark’s point, GR 22 prohibits you from buying the Confidential Info Form, Domestic Violence Info Form, and LEIS if there was a restraining order, but otherwise counsel for a party can buy sealed pleadings. GR 22(h)(2).<o:p></o:p></p>
<p class="MsoNormal">Feel free to call me if you have questions about the logistics. I’ve braved the courthouse a few times during the pandemic to buy sealed reports.<o:p></o:p></p>
