<p class="MsoNormal"><span style="font-size:11.0pt">I have a client who wishes to amend her RLT to omit one of her two sons. Both sons are currently listed in the RLT as co-successor trustees and are the sole beneficiaries of the RLT. The RLT Act requires
the trustor to amend the RLT in accordance with the procedure set forth in the RLT. Here, the RLT requires only that the Grantor provide notice of the change in terms or beneficiaries by delivering written notice of such revocation or amendment to the Trustee,
who is also the Grantor. <o:p></o:p></span></p>

<p class="MsoNormal"><span style="font-size:11.0pt">Is my client required to provide notice of the amendment or restatement to her RLT to a successor trustee and beneficiary? Although it may be best practice to notify the omitted son of the amendment or restatement,
I am not sure my client wishes to do that. She is near the end of her life, has terminal cancer, and does not wish to spend her last days fighting with a son she has not seen in more than a decade.
