I recently brought a TEDRA action and argued discovery rule and statute of limitations. Here is my argument, seems it might fit if you can prove the father, who should have inherited the monies from the sale, was unaware of the sale and his inheritance and had no idea the probate had been closed administratively. Of course, there is language about “should have known” which may play a part. I would have to do some research on this but this might be something to consider.
