<p class="MsoNormal"><span style="font-size:11.0pt">I’m representing a wife as PR in a Washington probate for her deceased husband. She and her husband were OR residents but the probate was opened in WA for various reasons and they have assets in Washington.
They also own 2 parcels of real property in Oregon. One deed identifies them as “tenants in the entirety” and one as “husband and wife”. Am I correct that both parcels pass to the surviving spouse on the death of husband and all that is required is the recording
of a certified DC, and an OR probate isn’t needed for the transfer? The recorders sites calls for a short form DC. Is it advisable to also file an affidavit of surviving spouse? The husband had a Will admitted to probate in Washington that left everything
to wife. <o:p></o:p></span></p>
