the there is a paragraph that states who all the heirs, legatees and devises are (name, address and relationship to decedent). I know the statute requires this information in intestate estate petition, and possibly it just got into our testate petition from
the intestate petition. I do not have a cite to a specific RCW, but in my testate petition I do include this information.<o:p></o:p></span></p>

of Probate. And I think possibly the two different notices may have been conflated in the discussion. (Or maybe I just didn’t read it carefully enough, and if that is the case – sorry for this interruption.)<o:p></o:p></span></p>
<p class="MsoNormal"><span style="font-family:"Calibri",sans-serif;color:blue"><o:p> </o:p></span></p>
<p class="MsoNormal"><span style="font-family:"Calibri",sans-serif;color:blue">As I understand it if there is a will and it names a PR who will be petitioning the court for appointment and nonintervention powers, you do not need to give any notice of the hearing
after 40 days from date of death. If within the 40 days, you must give notice of the hearing or have surviving spouse waive. (This relates to hearing appointing and granting nonintervention powers).<o:p></o:p></span></p>
<p class="MsoNormal"><span style="font-family:"Calibri",sans-serif;color:blue"><o:p> </o:p></span></p>
<p class="MsoNormal"><span style="font-family:"Calibri",sans-serif;color:blue">If the estate is intestate or the proposed PR is not named in the will, and the surviving spouse is the proposed PR and all property is community property and all children are children
of that marriage, you do not need to give notice of the hearing to get nonintervention powers. If decedent has children, who are not the children of the surviving spouse, has separate property, or if someone other than surviving spouse is petitioning for
appointment and nonintervention powers then you must give notice of the hearing to all heirs who would take under intestacy, or they can waive notice.

<p class="MsoNormal"><span style="font-family:"Calibri",sans-serif;color:blue">The Notice of Pendency of Probate then is given after the PR has been appointed, which will start the 4-month SOL in which to contest the will. I give that notice to all the beneficiaries
of the will and to heirs who could take under intestacy if will was declared invalid.<o:p></o:p></span></p>

generally get that info (would be needed anyways to file estate tax returns). There is wiggle room in that statute says PR gives notice to those “</span><span style="font-size:14.0pt;color:black;background:white">whose names and addresses are known to him
or her” . </span><span style="font-size:11.0pt;font-family:"Calibri",sans-serif;color:#1F497D">I assume PR has a duty to make reasonable inquiry prior to notice and I have given notice outside the 20 days of appointment when we didn’t know named beneficiary/joint

all property is clearly community property and all kids product of that marriage, then I will just give notice to surviving spouse. Otherwise, I usually give notice to all of decedent’s children as well, along with cover letter explaining generally why they
are getting notice (but are not necessarily receiving anything to curb any unreasonable expectations). You also need to remember to give notice to those beneficiaries under life insurance, IRAS, JTWROS, etc., who receive non-probate property. Although not
necessarily required, I list all beneficiaries/intestate heirs in petition as best I can. FWIW, Cy<o:p></o:p></span></p>

<p class="MsoNormal">I send the notice to heirs etc. because I always seek to obtain non-intervention powers. My read of 11.68.041 states that I don't have to send ADVANCE notice (which I read as to mean, I still need to send notice after I get the letters)
if I am getting the powers pursuant to 11.68.011. For me the hinge on the insertion of the word advance means that the legislative intent is that there would still be notice provided, just not before getting the letters issued.<o:p></o:p></p>
