You may not be able to include in petition, but once PR is appointed I believe they can generally get that info (would be needed anyways to file estate tax returns). If a long term marriage, all property is clearly community property and all kids product of that marriage, then I will just give notice to surviving spouse. Otherwise, I usually give notice to all of decedent’s children as well, along with cover letter explaining generally why they are getting notice (but are not necessarily receiving anything to curb any unreasonable expectations). You also need to remember to give notice to those beneficiaries under life insurance, IRAS, JTWROS, etc., who receive non-probate property. Although not necessarily required, I list all beneficiaries/intestate heirs in petition as best I can. My read of 11.68.041 states that I don't have to send ADVANCE notice (which I read as to mean, I still need to send notice after I get the letters) if I am getting the powers pursuant to 11.68.011.
