I would think all you need is a hearing with SS petition to transfer PR duties. Alternate beneficiaries have no standing if SS is 100% beneficiary of estate. When he dies, it all passes through his estate via his will or intestate succession.

<p class="MsoNormal">I have a 95 year old client who lost his spouse. I started a probate and helped resolve the wrongful death case. Husband is deteriorating mentally and he wants his brother, who is his acting POA, to take over PR duties. My client, the
surviving spouse is the 100% beneficiary of his wife's estate. They have no children. The Will lists one alternate PR who is now deceased. There are various alternate beneficiaries - some are dead, others are out of state, and 25% goes to the brother of
my client who is POA and wants to be the new Personal Representative. <o:p></o:p></p>
