opinion (link below) will cause our superior courts to abandon
their practice of scheduling case review hearings concerning
estates for which the PR has been granted nonintervention powers
(but I doubt that they will abandon that unauthorized practice).<br>

I thought it was unfortunate that the Rathbone opinion repeatedly
used the phrase "nonintervention will" and emphasized the
testator's language in the will as a basis for its ruling. That
phrase ("nonintervention will") does not appear in RCW Ch. 11.68
except in the code reviser's caption to section 11.68.090. But
the body of that statute (namely, the law) uses the phrase
"personal representative acting under nonintervention powers"
because RCW 11.68.011 (as its predecessor, 11.68.010) plainly
allows courts to grant nonintervention powers to PRs of intestate
estates, also. The holdings of Rathbone should apply equally to
all PRs with nonintervention powers, whether of a testate or
intestate estate.<br>
