Assuming the PR has nonintervention powers, RCW 11.68.090 grants a
PR the same powers as a trustee under RCW Ch. 11.98. In addition to
that chapter's section .071, authority for a trustee to engage an
agent to perform any act is found in .070(27).<br>
<br>
My suggestion is to draft a short "Agency Agreement" with recitals
that reference the PR's appointment and the foregoing RCWs,
paragraphs that define the authority granted to the agent, and by
which the agent accepts the appointment and acknowledges that he/she
is a fiduciary subject to the jurisdiction of the court supervising
the estate.<br>
<br>
I would not title the appointing documents a "power of attorney"
because I believe that refers to an individual principal delegating
their own personal civil authority to an agent and does not refer to
a fiduciary (e.g., trustee, corporate director/officer, public
official) delegating the authority of their position/office.<br>
<br>
As I skimmed the newly enacted Uniform Power of Attorney Act (Ch.
209, 2016 Laws of WA, effective in 2017), it does not appear to
contemplate the delegation of fiduciary powers. It defines
"principal" as "an individual who grants authority to an agent"
which I believe is consistent with my view. If that Act had
contemplated a fiduciary using a "power of attorney" to delegate
authority to an agent, then its section 110 would have provided that
the agent's authority terminates when the principal ceases to be a
fiduciary (e.g., is removed).<br>
