the small sum, don't spend much time on it. Perhaps if you ask
superior court comm'r to issue a citation to the bank to appear
and explain (or restore $700) and serve that on the bank, it will
simply restore the funds. I suggest that the bank prudently
should have (but was not required to) froze the account when you

<p class="MsoNormal">I opened probate and appointed an
Administrator (grandmother) for her son’s estate. There were
2 minor daughters living with grandma. Had a GAL appointed.<o:p></o:p></p>
<p class="MsoNormal">I obtain the monies from another attorney
for the PI settlement of her son – nothing to do with his
death.<o:p></o:p></p>
<p class="MsoNormal">The monies are paid to the estate and the
grandma/Administrator deposits the monies into the estate
account.<o:p></o:p></p>
<p class="MsoNormal"><o:p> </o:p></p>
<p class="MsoNormal">Fast forward a year and the Administrator
stops communicating with me. I finally go to court to have
her removed and the Court appoints me as Administrator.<o:p></o:p></p>
<p class="MsoNormal">I take the Order Removing to Umpqua Bank
where the estate account is… the manager indicates she has to
contact their legal dept to verify I can have access to the
bank statements and account.<o:p></o:p></p>
<p class="MsoNormal">A few months go by and I get back to Umpqua
Bank, finally being able to sign a signature card and
realizing that over $16k has been taken by former
Administrator for her house payments, insurance, etc.<o:p></o:p></p>
<p class="MsoNormal"><o:p> </o:p></p>
<p class="MsoNormal">When I get the statements, I see that
Umpqua has allowed the former Administrator to withdraw at the
bank $700 in cash. This is a month AFTER I took the Order
removing the Administrator and appointing me. I contact
Umpqua about the withdrawal and the response was – you didn’t
sign the signature card so too bad.<o:p></o:p></p>
<p class="MsoNormal"><o:p> </o:p></p>
<p class="MsoNormal">I am not versed in banking laws but my
opinion is that the Order Removing was enough to alert Umpqua
NOT to give her any money!!!<o:p></o:p></p>
<p class="MsoNormal">What is the next step – sue the bank for
the $700? District Court?<o:p></o:p></p>
