<font face="Times New Roman, Times, serif">The reason the law was changed
in 1996 to require GAL appointments to rotate through a list</font>
of qualified GALs was because before that, in some cases, the lawyer
for a petitioner would hand-pick a cooperative colleague as GAL to
ensure the petitioner's desired outcome. There appeared to be
somewhat of a cross-referrral network of lawyers who sometimes were
GALs and sometimes represented petitioners. But that was back in
the early 1990s.<br>
<br>
The superior court judges who implemented the mandatory rotation of
GAL appointments acted as though the legislation was driven by
economics -- to equitably distribute the paying GAL assignments --
but that was not what drove that legislation. The legislation was
driven by our desire to ensure that assigned GALs were independent
from and not beholden to petitioners' lawyers who previously
nominated them.<br>

Any tainting advance communications that a petitioner's lawyer now
has with any GAL that he/she nominates should be fully disclosed so
the subsequent lawyer retained by or appointed for the AIP can
object to that GAL, if appropriate.<br>
