It depends on what the powers of the trust protector are. If the only power of the trust protector is to remove and appoint trustees or if the trust indicates that the trust protector is acting in a nonfiduciary capacity, then under RCW 11.98B.030(2) the trust protector would not be subject to RCW 11.98B.

We work with Directed Trusts and Trust Protectors in a growing number of our trusts, and it is my position that the role of Trust Protector comes within the statutory provisions of RCW 11.98B. I'm heading out for the long weekend, but would be happy to discuss this role, options, how it works, etc. with you next week.
Curious of others agree with my thinking on the statutory provisions.

We are hoping to speak to someone who has recently named a Trust Protector in a revocable or testamentary trust. We understand that this is different from naming a statutory Trust Director, but we need to educate ourselves further as to how each role works.
