I should restate my answer - separate property (an inheritance) passes also, in part, to a surviving spouse under the laws of intestacy.  I assumed there was not one.  Should not have done this.

Hello list mates,

Mother passed away and PR opened up a probate. The mother’s will states everything goes to the three children in equal shares, per capita.  One of the children (a son) died after the mother passed away about a year later while the probate was still open.  The son still gets his share, but it passes according to the son’s will, correct?  Or to his issue if he didn’t have a will.
