[WSBAPT] Clarification re: Compensation for PR under new RCW 11.48.210

Colleagues -
There seems to be some confusion around PR Compensation from my
presentation. Let me try to help.
First, if I have an estate where I have NIP, I will not be doing anything
different in closing my estates. A Declaration of Completion that provides
PR comp, Atty Fees, Appraisers, and Tax Professionals.
If I have NIP now (because there is an estate already opened ) but my PR is
under the new "Sub-3" desigiation as any reasonable person and they are
going to be paid from proceeds from an underlying WD/Tort.....my advice to
that client is that we should file with the Court advising of this and get
the Court blessing for the PR to be paid from those proceeds and NOT the
estate ......as we all know, an underlying Tort award may not be considered
estate funds so this would run afoul of the new language in 11.48.210.
If I open a new estate with a Sub-3 PR under the new rules, there will be
no NIP. Ergo, when we are done, a petition to close is required and during
that time I will need to put forth the PR compensation to be deemed
reasonable.
When looking at my slides - and I take full blame for this being so deep
into the weeds - it is important to look at the totality of the BILL that
was passed and how the various sections interplay with each other.
