[WSBAPT] Primary Residence in Trust, but No Trust Doc....

If the house is in the name of a Trust; why not just create a trust in that name?  Clients must have had the intent to create a trust when they signed the deed, so now formalize it.

Hi All,

 

 

I have a client who some how had previously quit claimed their primary residence to a RLT, but they told me they have never signed an RLT document. Has anyone encountered this?

 

My thoughts as next steps:

 

TEDRA to undo? 

 

Or using RCW 11.98.014, consider their prior trust to be an oral trust, and simply quit claim to their new trust?
