Based on prior posts in this Listserv, I thought a Lack of Probate Affidavit would not be necessary under these circumstances. And now I am questioning whether or not a REETA is necessary as well.

Subject: Re: [WSBAPT] Recording CPA & Death Certificate
I typically record the death certificate with the CP Lack of Probate Affidavit, as an exhibit.
After death I think the deceased spouse should be listed as the Grantor and the surviving spouse as Grantee. The legal description and parcel number for any real property intended to be covered should be listed on the coversheet as well of course.

Subject: [WSBAPT] Recording CPA & Death Certificate
Dear All:
Husband and Wife had a Community Property Agreement that was never recorded. Wife died.
Can the CPA and the Death Certificate be recorded together? If so, who should be listed as Grantee on the cover page - just the Husband or both Husband and Wife?
Thanks in advance for offering me some common sense here.
