It’s a joint living trust, and no, the attorney in Oregon (they didn’t restate after moving and before one spouse passed) didn’t leave much flexibility, unfortunately.

So the Will isn't worded in such a way that funding the bypass trust is optional in a case like this where it isn't needed? That's unusual.

Anyone have a template they could share for a NJSA to skip a bypass trust? RLT created when the exemption was lower, spouse passed just before it went up to $3 million, and now it would serve no purpose. Surviving spouse and all their kids are in agreement.
