Dana, I am not certain if you were the original author of the documents -
but I will share that in an attempt to keep costs (un)reasonably low in my
early years I would take matters like this and change just the one thing
but not review the entire document. It came back to haunt me.
1) Trust that wasn't a Washington trust, but only discovered after death.
If I had reviewed it, I could have changed the situs but instead we had
trust administration under the ORS.
2) Defective trust that didn't have the paragraph relating to residual
distribution and so the end result was people getting money client wanted
to exclude.
3) Just last week in review of another persons estate plan - defective
execution on two codicils, a Healthcare POA that was provided by a Hospital
that was not witnessed nor notarized.
All of this is to say that ever since I have required a full review and
read through of documents the vast majority have included issues that the
client knew nothing about and was happy that I caught it. One client went
as far as to say - that is never what they intended. Just in case you are
curious, no, that was not a client with cognitive issues, their prior
attorney either didn't listen or copied and pasted someone elses plan but
they didn't do the page by page walk through at the signing.
Just my word of caution about making the one simple change.
