I think you have to start with RCW 11.98.005 and run through all the different bases for determining if Washington is a viable situs for the trust. Note also RCW 11.98.039(6). If you can establish Washington as situs, then I think you can use TEDRA in Washington.

If there was a probate in Washington that established the trust, that might be enough. See also RCW 11.96A.050(1)(a).

Seeking input from the learned body of this list on a trust administration/TEDRA question.

Beneficiary of a now irrevocable trust due to Husband's passing is a WA resident. Trustee is a CA resident, not administering the Trust according to the Trust document. Trust provides validity determined under Oregon law, and questions related to construction and administration to be determined by reference to the law of the state in which the Trust is currently being administered. Repeated efforts to engage with trustee and trustee's counsel in CA have mostly gone unanswered or answered unsatisfactorily, and Trust administration remains deficient to the detriment of Beneficiary.

Can a TEDRA action be maintained in WA, or does Beneficiary need to seek CA counsel?
