I recently made the mistake of trying to present these in person, but the clerk insisted I had to pay the EPVC $30 fee.

Pro Tip: I filed the probate petition first, so I had a case number to put in the Order to Remove Will from Repository. That way I did not have to physically pick up the Will, write the probate case number, and hand it back to them.

Hi All,

I drafted a will for a client now deceased that was deposited into the Will repository.  His named PR has now retained our firm to initiate probate.

I am realizing that I do not have the procedures down for getting a will deposited in the repository into a probate matter.  The only guidance I can find is as follows from KCSC’s website:

Any other person, such as an attorney or Guardian, may withdraw the original will only with a court order after showing of good cause. Upon request and presentation of a certified copy of the testator’s death certificate, the Clerk’s Office will unseal the file. If a probate file is opened at that time, the full filing fee must be charged per RCW 36.18.020(2)(f).

How does one seek to have the Will moved over?  Is there a separate Ex Parte Motion / Order submitted with the Verified Petition to Probate that you normally file?  Exemplary samples (or case numbers for me to review) greatly appreciated. :)
