In what kinds of circumstances have you needed s blocked account for a probate or trust matter? Are these always court ordered? Or do you and a PR client simply know/agree it's best and thus implement one?

Any answers at all will be illuminating, if you have time to reply.

Until this exchange among Eric, Brent and Dalynne, I had never heard of a blocked account that someone sets up intentionally.

(Blocked or frozen accounts made me think drug money or mafia and the feds freezing or seizing an account.)

Joshua, not a day goes by that I don't learn something new.  It is one reason I decided to handle probate, estates and TEDRA cases.

It is rare, but I have had court orders in probate for blocked accounts.  One recently was for a wayward PR who was threatening to take monies out of the account in distribution to herself, fired her atty and the court stepped in at an emergency hearing before the motion to remove and replace the PR was heard.  In addition, when I have probate monies in my firm's trust account and they are sizeable (usually from wrongful death settlement subject to RCW 4.20 or from a home sale), I sometimes get agreement between the potential heirs/beneficiaries and PR/Admin. to move to a blocked trust account which earns interest while we deal with TEDRA or allocation of wrongful death money issues.

Absolutely love your first paragraph and could not agree more!

Excellent summary. So in this example -- "agreement between the potential heirs/beneficiaries and PR/Admin. to move to a blocked trust account which earns interest while we deal with TEDRA or allocation of wrongful death money issues" -- does the PR or trustee ultimately open the account at the bank, I assume?

Is it basically that person opening an account but agreeing with the institution that the institution is not to accept their ordinary withdrawal instructions or honor checks until some other contingency is met that THEN authorizes withdrawal or direct distribution to some third party?

Joshua, not a day goes by that I don?t learn something new.  It is one reason I decided to handle probate, estates and TEDRA cases.

It is rare, but I have had court orders in probate for blocked accounts.  One recently was for a wayward PR who was threatening to take monies out of the account in distribution to herself, fired her atty and the court stepped in at an emergency hearing before the motion to remove and replace the PR was heard.  In addition, when I have probate monies in my firm?s trust account and they are sizeable (usually from wrongful death settlement subject to RCW 4.20 or from a home sale), I sometimes get agreement between the potential heirs/beneficiaries and PR/Admin. to move to a blocked trust account which earns interest while we deal with TEDRA or allocation of wrongful death money issues.

I will ask for myself and what must be several others who are wondering the same:

In what kinds of circumstances have you needed s blocked account for a probate or trust matter? Are these always court ordered? Or do you and a PR client simply know/agree it's best and thus implement one?

Any answers at all will be illuminating, if you have time to reply.

Until this exchange among Eric, Brent and Dalynne, I had never heard of a blocked account that someone sets up intentionally.

(Blocked or frozen accounts made me think drug money or mafia and the feds freezing or seizing an account.)

I have an estate where I think I?m going to need to set up a blocked account, and I haven?t done one in 10+ years. Does anyone have more recent experience?are there banks that refuse to deal with blocked accounts, would a credit union work better, any thoughts or war stories or suggestions?
