Not at all. Significantly better option, not to mention the manifestly better asset protection and administration options beneficiaries benefit from when a trust is done well. Best, Josh

Is selling property within two years of death an issue if the property transfer occurs via a RLT?

In my recent experience - NO - the notice to creditors for the probate estate DID NOT fix that problem. They insisted on a Deed of PR.....the end result to make them happy was literally having the beneficiaries of the house send $90k to my office to hold to resolve any potential creditor claims.

I strongly advise against using a TODD if there is an potential sale within 2 years of death.

I have heard that title companies don't want to insure title on a sale of property within two years of death if the title transferred pursuant to a TODD.

Does doing a non-probate notice to creditors following a TODD help facilitate a sale within two years?
