Hello listmates,
I have a PC that needs to open a probate that involves the slayer statute and I am hoping someone out there can offer some advice. The named PR in decedent's will has been charged with causing the death, PC is the named successor PR. Slayer (S) and decedent (D) were related and lived together in a house that they owned JTWROS. S does not have any other assets and now needs a hefty amount to pay their criminal attorney. For that reason, S attempted to secure a loan using their interest in the house as collateral and were rejected. PC is a descendant of both S and D and wants to see S be able to get the money they need to pay the lawyer. PC and a sibling are the only other heirs, and both agree that they want to help S. Will S be able to get a loan if the appointed PR consents, or will S have to obtain a court-ordered separation of the property? Is there any reason PC should not cooperate with S to secure a loan? Should I be concerned about getting nonintervention powers? Any other pitfalls I haven't even thought of yet? Thanks in advance for any thoughts.
