[WSBAPT] Charles Schwab Retirement Account

Good Morning -

I have an interesting scenario.

Client is the surviving spouse of Bob.

They were married 10 years and had a Community Property Agreement.

Bob died April 14.

Client just found out that Bob had not changed the beneficiary on his retirement account, and Charles Schwab paid it out (about $60k) to his estranged adult kids as the named beneficiaries from long ago and never updated.

Client is entitled to the funds under the Community Property Agreement.

I had a case just like this a couple years ago, and wrote a letter to the Financial company and was able to obtain the funds, but the major difference there was that the funds had been placed into a new account but not yet paid out.

Any thoughts or suggestions other than to revise my letter from the previous scenario and send it to Charles Schwab?
