If it was all Community property so that the surviving spouse who died with the will received everything from her or his deceased spouse why couldn't you do a affidavit of non probate as to the intestate spouses interest especially if all you had was family home or maybe one or two pieces of real estate I know this would satisfy the title company as I have done it many times

Subject: [WSBAPT] Probate for a Married Couple - Letters Testamentary or Letters of Administration
Has anyone opened one probate in King County for a married couple when the husband died intestate and the wife died testate? In this case, husband died intestate a year before the wife and probate was never opened for him and wife then died with a Will. Everything goes to two adult children and no complications. I prefer to open one probate matter for the two estates if it can be done easily. I am afraid the court would reject it since the Court issues Letters of Administration for an intestate estate and a Letters Testamentary for a testate estate. If that doesn't work, then I will file separate petitions. Thank you in advance for any comments!
