[WSBAPT] WSBAPT Digest, Vol 121, Issue 20

I drafted one Will in 25 years where the testatrix did not want to give her daughter NPs. A simple waiver from all named in the Will would normally suffice if you are submitting ExPVC:

  1. The undersigned is named as a beneficiary under the XYZ Will.
  2. The undersigned requests that the court waive bond.
  3. The undersigned requests that the court grant non-intervention powers and waives notice of same.

Subject: [WSBARP] Waiver of Bond

 Hello all,

I am handling a new probate where the decedent's will makes no mention of waiving bond. The will was prepared by a reputable firm in Seattle, so I am scratching my head, wondering why that was not included, given the named executrix. I doubt whether it was even discussed with the testatrix. One of the two adult daughters is the executrix. She and sister share equally in the residuary estate after $15k to each of 4 grandkids (all adults). The statute says that there needs to be something in the will that evidences the testator's intent to waive bond. Is there any way to not require bond? I am hoping that someone out there has experience with obtaining waivers of bond from the heirs named in the will. I assume that I would have to get waivers from the grandkids as well as the two daughters?

Does anyone have a handy form for this purpose?

Kristen Anderson
