I generally allow children into the meeting with the parents, unless I know in advance that it is a sensitive situation. When the children do attend, if they start interfering, I asked them to leave. In any event, towards the end of the meeting, I always ask the children to leave so that I can talk to their parents alone and make sure the parents are on board with what we are going to be doing. And when I ask questions of the parents, I do not allow the children to interrupt and respond.

Subject: [WSBAPT] Drafting Will - Interfering Children
Listmates: This is just a Friday afternoon rant. More and more children try to tell me how to draft their parent’s Will. I never allow children, or anyone else, into my meeting with the parent(s), no matter how insistent the child is, or even the parent is in wanting the child in the meeting. Have you experienced this, and if so, what do you do. If a parent is not able to tell me what they want, I won’t prepare anything. Clearly not competent to sign. Just had some children rant about the mom’s will as being all wrong and not what they wanted her to do. Apparently one of the children set up a “family trust” and wanted mom to leave everything to it. Yikes, talk about undue influence.
Just my Friday night WTF moment.
