A beneficiary of a trust is entitled to receive periodic distributions from the trust based on a percentage of the value of the trust assets.  Whenever the Successor Trustee makes a distribution, s/he subjects the distribution to withholding for taxes.

Successor Trustee is also paying him/herself a "trustee's fee," also based on a percentage of the value of the trust assets.  However, the Successor Trustee does not withhold anything from the money s/he takes as the trustee fee.

Is this kosher?
