Correct, all the way down to the bottom of the living chain, I’m afraid. If a sibling of Decedent’s parent (that is, an aunt or uncle) had a child (first cousin) who died before the Decedent but had children of their own, those the first cousin’s children are the Decedent’s first cousins once removed, and inherit their deceased parent’s share by right of representation.
A “second cousin,” by the way, is apparently a grandchild of a Decedent’s grandparent’s sibling. At least according to a chart I have from HeirSearch.com. Confusingly, “first cousins once removed” appears to include both the children of aunts and uncles (parent’s siblings), AND the children of grand-aunts and grand-uncles (grandparent’s siblings).

Listmates, How far down the lineal descending line do I have to research to establish intestate heirship under RCW 11.04.015(2)(e)? Until I run out of living lineal descendants? The decedent’s closet living relatives are two first cousins, children of a deceased aunt, but decedent had 8 first cousins who predeceased him. Do I have to figure out if the first cousins had children (ie. do second cousins get to inherit by right of representation?) - Shannon
