If this series of absurd events does not FINALLY result in Congress or the Court implementing a straightforward rule or process for the issuance and appellate review of the now ubiquitous NATIONWIDE INJUNCTIONS — using forth freely from single federal judges everywhere and anywhere! — then I don’t know what will.

This is no way for our federal judicial system to treat Americans (or their public institutions and servants) in the DAYS preceding such a deadline. We've invented three-judge panels; we could -- imagine! -- skip motions panels in favor of merits panels; empower the circuit justice to decide and make his/her stay decision final pending completion of the circuit court appeal. (Those ideas took me all of 17 seconds to conjure up just now!)

Enough should be enough. But heaven only knows if it will be in our present environment.

For those following along, last night the 5th Circuit signed an order that reversed and vacated its prior ruling from Monday.  Here is a quote from the order.

“The merits panel now has the appeal, which remains expedited, and a briefing schedule will issue forthwith. However, in order to preserve the constitutional status quo while the merits panel considers the parties’ weighty substantive arguments, that part of the motions-panel order granting the Government’s motion to stay the district court’s preliminary injunction enjoining enforcement of the CTA and the Reporting Rule is VACATED. “
