Colleagues,
During the pendency of a probate, one of the beneficiaries died. We are
ready to close the probate and a family member of the deceased individual is
objecting to any check made out to the "Estate of" the deceased beneficiary,
and want it made out to the Trustee of beneficiary's Trust. The deceased
beneficiary resided in CA so I assume they don't want to open a probate.
The PR and I should not be in the position of ascertaining who is entitled
to this money or unwittingly participating in anything improper. There is a
second marriage, deceased beneficiary was on some kind of benefits program,
and may be more than one trust. Lawyers for the Trustee are involved. PR
wants to be accommodating if possible.
Has anyone dealt with this type of a situation & have words of wisdom?
Thank you,
Mimi M. Wagner
