I’ll be interested in reading the answers. I assume your client is a WA resident and generally, in the context of Probate, the exemption is allowed for certain heirs only upon Petition. It seems allowing out of state to qualify defeats the spirit of the WA law for a WA resident but that is simply my initial, off-the cuff opinion.

Subject: [WSBAPT] Washington homestead and property in Texas trust

Hello all,

I've had someone ask whether Washington State real property that has been placed in a Texas revocable trust qualifies for Washington's homestead exemption. After some research I want to say yes, but realize this could always be one of those 'don't know what I don't know' situations.

Has anyone dealt with this question in some context?

Thanks a bunch for any assistance.
