Colleagues,

I am assisting a family with locating an attorney or firm to handle the probate of their deceased brother, a solo practitioner who practiced out of his home in Federal Way.  I have someone in mind but would like to additional options, just in case.  As I understand it, there are two roles - the probate proceeding and winding down the deceased attorney's law firm.  There are some attorneys/firms who are willing to handle both, while others aren't.  If you know of anyone who practices in this area, please let me know. Hi all:

A potential client's husband recently passed away. They don't own any real estate, any banking assets were owned by them jointly, and their children are children in common. The husband had a life insurance policy on which he designated the surviving spouse as beneficiary. The wife found about $20k of credit card debt that the husband took out that she was previously unaware of. There are also some medical bills from the decedent's illness.
A couple questions:

(1) If the decedent and the surviving spouse had joint banking, are half of those assets available to his creditors?

(2) I don't see a reason to open probate, because there are no assets that need to be moved from the decedent to the surviving spouse. Is this a situation in which a Nonprobate Notice to Creditors might be a good idea?

(3) But, if life insurance is the only asset (assuming a "no" answer to my
Q#1 above), is a Nonprobate Notice to Creditors needed? I understand wanting to cut off any claims, but it seems a little strange to publish a notice while knowing all claims will be rejected.

Hoping to help the PI bar.  Have a Chinese National who has a large injury settlement (beneficiary).  Her daughter, who lives in China, is her Agent under a DPOA.  Daughter wants to move mother (bene) back to China.  The Washington courts have jurisdiction over the settlement funds and, along with the SGAL must consider SPR 98.16W.   Ohana being considered as trustee, but attorney for bene (the PI lawyer) is not in favor of setting up a US based trust for someone moving to China to be looked after by Chinese daughter in China, which I can understand.

I'm a bit out of my depth here, but it seems to me that the family needs to speak with an attorney here in the US who is fluent in Chinese trust law.  Of perhaps an attorney in China who can figure this all out.  Any thoughts?

Do you go under RCW 4.12.030?  I could not find anything in the probate code dealing with moving a proceeding.  Your thoughts.

Listmates:



Probate started in a county completely unrelated to the decedent?s county of passing, other than the matter was filed where the estate attorneys are located.  PR obviously blessed the move for tactical reasons, although PR resides in county of decedent?s death as are all other heirs but one ( who also wants the matter moved).  What is the process to move the proceeding? Do you go under RCW 4.12.030?  I could not find anything in the probate code dealing with moving a proceeding.  Your thoughts.

Generally credit card debt taken out during the marriage is community debt, in which case the entire community property estate (including survivor?s half) can be used to satisfy the debt.  See RCW 11.10.030.  Joint bank accounts can absolutely be subject to creditors (see RCW 11.18.200), though the life insurance would be exempt.  I suppose if the credit cards were taken out without her knowledge and were used solely for separate expenses and not used for community expenses you could make the argument that it is separate debt, but the decedent?s portion of the community property is still reachable.  I personally would probably file a probate, provide/publish notice to creditors, and petition the court for an award of family support/award in lieu of homestead under RCW 11.54.010.

Hi all:

A potential client's husband recently passed away. They don't own any real estate, any banking assets were owned by them jointly, and their children are children in common. The husband had a life insurance policy on which he designated the surviving spouse as beneficiary. The wife found about $20k of credit card debt that the husband took out that she was previously unaware of. There are also some medical bills from the decedent's illness. A couple questions:

(1) If the decedent and the surviving spouse had joint banking, are half of those assets available to his creditors?

(2) I don't see a reason to open probate, because there are no assets that need to be moved from the decedent to the surviving spouse. Is this a situation in which a Nonprobate Notice to Creditors might be a good idea?

(3) But, if life insurance is the only asset (assuming a "no" answer to my Q#1 above), is a Nonprobate Notice to Creditors needed? I understand wanting to cut off any claims, but it seems a little strange to publish a notice while knowing all claims will be rejected.
