Decedent inherited property "as a married person but as his separate
property." Will recording the Community Property Agreement transfer
insurable title to the surviving spouse? Recently it was discussed that an
affidavit of lack of probate could not be used to transfer title for the
deceased spouse's separate real property to the surviving spouse and that
probate had to be used. Here we have a community property agreement that
expressly states that on death all separate property, of the deceased
spouse, becomes community and goes to surviving spouse. Your thoughts.
