I also think you could file under some abandonment law.........declared dead process (I used this once when no body could be found and surviving spouse really needed to process the estate to financially survive - it's been awhile but I think I may have gone with TEDRA......

I meant by the legislature.  There are many situations what family law should accommodate.

Divorce should be granted if one is alive.  Methinks a thorough review of divorce law is in order.

Has anyone started an intestate probate where the whereabouts of the spouse, indeed whether or not he is still alive, were entirely unknown. Spouse of decent, despite years of searching by the decedent have been unknown for a decade or more since he was denied a green card and returned to his home country, severing all relationship with the decedent.

Decedent has a surviving adult child (not child of the missing spouse) who wants to be appointed Personal Representative. Not sure what a Court will do with the "missing spouse" angle.
