Sounds like a tenancy in common; if so, the H can do dot from him only; but it is pretty minimal security.  It would take a lot to realize any money from a forced sale.

I'd like to prepare a deed of trust to secure a husband's obligation to pay his wife as part of a divorce. The real property was acquired before marriage by the husband and his father, and is titled in both their names .

Question - Does the father need to be named as a co-grantor in the deed of trust?
